Terms of Service

Senflux is a technology platform focused on Capital Intelligence and Automated Deployment within the digital-asset ecosystem.

The platform is designed to process observable on-chain and market information, identify developing market formations, evaluate those formations against defined system conditions, and facilitate automated deployment when qualifying conditions are identified.

Senflux currently operates within the Solana ecosystem.

Senflux is designed to provide technology, intelligence, software, analytics, automation, and related infrastructure. Senflux does not represent that any particular market condition, signal, formation, deployment, or strategy will produce a profit.

The Services may evolve over time. Senflux may add, remove, modify, or discontinue features, markets, supported assets, intelligence modules, deployment mechanisms, interfaces, or other components of the Services.

For purposes of these Terms:

“Account” means the account or user profile through which you access the Services.

“Capital” means digital assets or other eligible assets made available for participation in the Services, as applicable.

“Capital Intelligence” means Senflux’s technology and analytical processes used to observe, process, compare, classify, and evaluate market and on-chain activity.

“Automated Deployment” means the initiation or execution of qualifying digital-asset transactions or other deployment actions through Senflux technology according to predefined system conditions.

“Formation” means a developing market condition or combination of observable signals that Senflux technology identifies and evaluates.

“Formation Conditions” means the system parameters, thresholds, signals, risk controls, liquidity conditions, market conditions, or other criteria used by Senflux to determine whether a Formation may qualify for deployment.

“Platform” means the Senflux website, application, interfaces, dashboards, software, systems, and associated infrastructure.

“Services” means the Platform and all associated products, technology, intelligence, automation, educational material, content, community features, and other services provided by Senflux.

You may use the Services only if:

• you are legally capable of entering into a binding agreement;
• you satisfy the minimum age requirement applicable in your jurisdiction;
• your use of the Services is lawful in the jurisdiction in which you reside;
• you are not subject to applicable sanctions or restrictions;
• you are not prohibited by applicable law from participating in digital-asset activities; and
• all information you provide to Senflux is accurate, complete, and current.

Senflux may restrict, suspend, or terminate access where it reasonably believes that a user does not satisfy applicable eligibility, compliance, security, or legal requirements.

You are responsible for determining whether use of the Services is lawful in your jurisdiction.

Senflux may restrict access to particular jurisdictions, users, assets, products, features, or services at any time.

Digital assets and automated market participation involve substantial risk.

You may lose some or all of the capital made available through the Services.

Digital-asset markets can experience substantial volatility, illiquidity, rapid price movements, slippage, market manipulation, network disruption, smart-contract vulnerabilities, technical failures, and other risks.

Senflux does not guarantee:

• profits;
• returns;
• a particular rate of performance;
• preservation of capital;
• successful execution of every transaction;
• successful execution at an expected price;
• that every Formation will develop;
• that every Formation will qualify for deployment;
• that every deployment will be profitable;
• that losses will not occur; or
• that the Services will achieve a particular financial result.

You should not commit capital that you cannot afford to lose.

Nothing in the Services constitutes a representation that any digital asset, market, Formation, signal, or deployment is suitable for you.

Information made available through Senflux, including market intelligence, analytics, signals, classifications, educational material, market commentary, dashboards, historical information, and other content, is provided for informational and technological purposes.

Nothing contained within the Services constitutes individualized:

• investment advice;
• financial advice;
• trading advice;
• tax advice;
• legal advice;
• accounting advice; or
• a recommendation to buy, sell, hold, or otherwise transact in any digital asset.

You are solely responsible for determining whether participation in the Services is appropriate for you and for obtaining independent professional advice where appropriate.

Senflux may analyze observable information from blockchain networks, decentralized protocols, markets, wallets, liquidity environments, transactions, and other data sources.

Such information may include:

• capital concentration;
• liquidity movement;
• participation growth;
• wallet activity;
• wallet clusters;
• capital rotation;
• transaction activity;
• market conditions;
• formation persistence;
• formation strength;
• historical activity patterns;
• asset and market relationships; and
• other observable on-chain or market information.

Senflux may use proprietary algorithms, models, methodologies, classifications, scoring systems, statistical processes, or other technology to process such information.

The resulting intelligence is an input into Senflux’s technology and does not constitute a guarantee that a particular market condition will continue or produce a particular result.

Senflux may identify developing market formations based on multiple observable conditions.

A Formation may be evaluated using factors including, without limitation:

• capital quality;
• capital concentration;
• liquidity migration;
• participation growth;
• wallet behavior;
• persistence;
• market momentum;
• liquidity conditions; and
• other proprietary or system-defined criteria.

A Formation may qualify for deployment only when applicable system conditions are satisfied.

Senflux may modify Formation Conditions, detection methodology, validation processes, risk parameters, or deployment criteria as the technology evolves.

Identification of a Formation does not mean that the Formation will mature, persist, remain liquid, or produce a profitable outcome.

Where enabled, Senflux may use automated systems to initiate or execute qualifying digital-asset transactions or other deployment actions.

Automated Deployment may involve:

• algorithms;
• software systems;
• smart contracts;
• blockchain transactions;
• third-party infrastructure;
• decentralized protocols;
• liquidity venues; and
• other technological systems.

Automated Deployment does not mean that:

• every Formation will result in a transaction;
• every transaction will execute successfully;
• every transaction will execute at the expected price;
• every transaction will be profitable;
• losses cannot occur; or
• human or technical intervention will never be required.

Transactions may be affected by network congestion, gas or network fees, liquidity, slippage, market movement, smart-contract behavior, failed transactions, protocol changes, technical failures, or other circumstances outside Senflux’s control.

Depending on the configuration of the Services, users may connect a compatible digital-asset wallet or use another supported account or funding method.

You are responsible for ensuring that:

• you control the wallet or account you connect;
• wallet credentials and private keys remain secure;
• transactions are reviewed where the Platform requires user confirmation;
• you understand the permissions granted to the Platform or associated smart contracts; and
• you do not provide private keys, seed phrases, or authentication credentials to unauthorized persons.

Senflux will not request your private wallet seed phrase.

Where a wallet connection or blockchain transaction is required, the relevant blockchain network may independently process the transaction.

Blockchain transactions may be irreversible.

Where the Services permit users to make Capital available for automated deployment, the applicable Capital structure, eligibility requirements, minimums, maximums, fees, deployment rules, and withdrawal procedures will be presented through the Platform or applicable product documentation.

Unless expressly stated otherwise, Senflux does not represent that all Capital made available by a user will be deployed at any particular time or at full capacity.

Capital availability, deployment capacity, and utilization may vary based on market conditions, liquidity, system conditions, risk parameters, technical conditions, compliance requirements, and other factors.

Senflux may offer different product tiers, licenses, subscriptions, participation levels, or other access structures.

Current or future product structures may differ in:

• intelligence coverage;
• platform features;
• monitoring capabilities;
• deployment capabilities;
• capital capacity;
• access duration;
• educational access;
• community access;
• fees; and
• other characteristics.

Senflux may modify, replace, introduce, or discontinue products or product tiers prospectively.

The applicable commercial terms presented at the time of purchase or activation will govern the relevant product, subject to these Terms and applicable law.

Fees may apply to access or use of certain Senflux products and Services.

Applicable fees will be displayed through the Platform, checkout process, product documentation, or other applicable communication before purchase or activation where reasonably practicable.

Unless expressly stated otherwise:

• platform fees are separate from trading Capital;
• fees do not represent a percentage of trading profits;
• payment of a fee does not guarantee any financial return; and
• fees are not themselves an investment.

Senflux may modify fees prospectively.

Third-party blockchain or network fees may also apply.

Where the Platform permits withdrawal of Capital or digital assets, withdrawals are subject to the applicable Platform procedures, blockchain conditions, security controls, compliance requirements, minimums, processing requirements, and any other applicable restrictions.

Senflux may delay, reject, or restrict a withdrawal where reasonably necessary because of:

• security concerns;
• suspected fraud;
• compliance review;
• sanctions screening;
• blockchain conditions;
• liquidity limitations;
• technical failures;
• network congestion;
• suspected unauthorized activity;
• legal or regulatory requirements; or
• other circumstances permitted under these Terms.

The availability of a withdrawal feature does not guarantee immediate settlement.

Senflux may publish historical, illustrative, simulated, example, or actual platform performance information where appropriate.

Any historical or illustrative performance information:

• is provided for informational purposes;
• is not a guarantee of future performance;
• is not a promise of income;
• is not a fixed rate of return;
• should not be interpreted as a forecast; and
• may differ materially from future results.

Actual results may vary substantially between users and over time.

Performance may be affected by market conditions, timing, liquidity, execution, fees, slippage, Capital allocation, system conditions, and other factors.

Past performance is not indicative of future results.

Digital-asset transactions may incur:

• blockchain network fees;
• protocol fees;
• trading fees;
• liquidity-provider fees;
• execution costs;
• slippage;
• withdrawal fees;
• third-party infrastructure fees; and
• other transaction-related costs.

The amount of such costs may change without notice based on network and market conditions.

Senflux does not guarantee execution at a particular price, spread, liquidity level, or cost.

The Services may interact with blockchain networks, smart contracts, decentralized protocols, liquidity pools, wallets, exchanges, infrastructure providers, and other third-party systems.

Blockchain-based activity involves risks including:

• network congestion;
• chain reorganizations or interruptions;
• smart-contract vulnerabilities;
• protocol exploits;
• oracle failures;
• liquidity loss;
• transaction failure;
• transaction delay;
• incorrect or malicious contract behavior;
• cyberattacks;
• private-key compromise;
• asset theft;
• protocol upgrades;
• governance changes; and
• technological failure.

Senflux cannot eliminate these risks and is not responsible for risks inherent to third-party networks or protocols except to the extent liability cannot lawfully be excluded.

Senflux may rely upon or interact with third-party providers, including:

• blockchain networks;
• decentralized protocols;
• wallets;
• data providers;
• infrastructure providers;
• liquidity venues;
• analytics providers;
• payment providers; and
• other external services.

Third-party services are independent from Senflux and may have their own terms, policies, risks, fees, and availability.

Senflux does not guarantee the availability, accuracy, security, performance, or continued operation of any third-party service.

You are responsible for maintaining the security of your Account and authentication methods.

You must promptly notify Senflux if you suspect:

• unauthorized account access;
• compromised credentials;
• suspicious activity;
• unauthorized transactions; or
• other security incidents.

You must not share authentication credentials with unauthorized persons.

Senflux may require additional verification or security measures to protect Accounts, Capital, users, or the Platform.

Senflux is not responsible for losses caused by a user’s failure to maintain appropriate account, device, wallet, or credential security, except to the extent liability cannot lawfully be excluded.

Senflux may implement compliance and security procedures including:

• identity verification;
• sanctions screening;
• transaction monitoring;
• source-of-funds checks;
• wallet screening;
• fraud prevention;
• risk assessment; and
• other compliance procedures.

Senflux may request information or documentation necessary to complete such procedures.

Senflux may delay, reject, restrict, freeze, or suspend activity where reasonably necessary for security, compliance, legal, or risk-management purposes.

Where required by law, Senflux may cooperate with competent governmental or regulatory authorities.

Senflux may restrict or prohibit access to the Services for persons located in, resident in, organized in, or otherwise connected to jurisdictions where use of the Services is prohibited, restricted, or presents material legal or regulatory risk.

Senflux may also restrict access for sanctioned persons or persons subject to applicable legal restrictions.

Senflux may update its restricted-jurisdiction policies from time to time.

Users are responsible for complying with all laws applicable to them.

Senflux may provide educational materials, community features, market commentary, training, events, Academy content, and other informational resources.

Educational or community content is not individualized financial or investment advice.

Statements made by community members, affiliates, leaders, ambassadors, or other participants do not necessarily represent the views of Senflux.

Senflux may moderate, restrict, suspend, or remove community access where necessary to maintain security, compliance, accuracy, or appropriate community standards.

Senflux may operate referral, affiliate, leadership, rank, community, or other incentive programs.

Participation may be subject to separate qualification criteria, policies, compensation schedules, compliance requirements, and program terms.

Eligibility for commissions or other rewards may depend on legitimate qualifying activity and satisfaction of applicable requirements.

Senflux may modify, suspend, or terminate incentive programs prospectively.

Users, affiliates, leaders, ambassadors, and community members must use only accurate and authorized information when discussing Senflux.

No person may:

• guarantee profits or returns;
• promise fixed monthly income;
• represent historical performance as guaranteed;
• make misleading earnings claims;
• misrepresent Senflux technology;
• fabricate testimonials or results;
• make unsupported claims about Senflux’s regulatory status;
• misrepresent risks;
• impersonate Senflux or its representatives; or
• make claims inconsistent with Senflux-approved materials.

Senflux may suspend or terminate accounts associated with prohibited promotional conduct.

All Senflux intellectual property, including:

• trademarks;
• logos;
• names;
• software;
• source code;
• interfaces;
• databases;
• algorithms;
• models;
• methodologies;
• documentation;
• graphics;
• videos;
• text;
• designs; and
• other proprietary materials

are owned by or licensed to Senflux and protected by applicable intellectual-property laws.

Except as expressly permitted by Senflux, you may not:

• reproduce;
• modify;
• distribute;
• publish;
• sell;
• sublicense;
• reverse engineer;
• extract;
• copy;
• commercially exploit; or
• create derivative works from

Senflux intellectual property.

You may not use the Services to:

• violate applicable law;
• commit fraud;
• launder money;
• finance prohibited activities;
• manipulate markets;
• impersonate another person;
• introduce malicious software;
• interfere with Platform operation;
• exploit security vulnerabilities;
• reverse engineer proprietary systems;
• circumvent Platform controls;
• access accounts or data without authorization;
• conduct unauthorized automated scraping or extraction;
• infringe intellectual-property rights; or
• engage in conduct that creates material legal, regulatory, security, or operational risk for Senflux or other users.

Senflux may suspend or terminate access to the Services where it reasonably determines that:

• these Terms have been violated;
• prohibited or fraudulent activity has occurred;
• security is at risk;
• applicable law or regulatory requirements require action;
• an Account presents material operational or compliance risk;
• unauthorized activity is suspected; or
• continued access is otherwise inappropriate.

Where reasonably practicable, Senflux may provide notice of suspension or termination.

Termination does not eliminate obligations that accrued before termination.

Treatment of any remaining Capital or digital assets following suspension or termination will be handled according to applicable Platform procedures, contractual rights, and applicable law.

Senflux aims to maintain reliable access to the Services but does not guarantee uninterrupted availability.

The Platform may become unavailable or limited because of:

• maintenance;
• upgrades;
• technical failures;
• cybersecurity incidents;
• blockchain network conditions;
• third-party infrastructure failures;
• market conditions;
• force majeure events; or
• other circumstances beyond Senflux’s reasonable control.

Senflux may modify or temporarily suspend portions of the Services where necessary.

Senflux’s collection, use, storage, and processing of personal information is governed by the applicable Senflux Privacy Policy, which forms part of these Terms by reference.

By using the Services, you acknowledge that Senflux may process information reasonably necessary to provide, secure, administer, improve, and comply with legal obligations relating to the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

SENFLUX DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND UNINTERRUPTED OPERATION.

SENFLUX DOES NOT WARRANT THAT:

• THE SERVICES WILL ALWAYS BE AVAILABLE;
• INFORMATION WILL ALWAYS BE COMPLETE OR ACCURATE;
• EVERY FORMATION WILL BE IDENTIFIED;
• EVERY IDENTIFIED FORMATION WILL QUALIFY;
• EVERY DEPLOYMENT WILL EXECUTE;
• EVERY TRANSACTION WILL EXECUTE AT THE EXPECTED PRICE;
• EVERY DEPLOYMENT WILL BE PROFITABLE;
• LOSSES WILL NOT OCCUR; OR
• THE SERVICES WILL PRODUCE ANY PARTICULAR FINANCIAL RESULT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SENFLUX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

THIS INCLUDES, WITHOUT LIMITATION, LOSSES ARISING FROM:

• MARKET MOVEMENTS;
• DIGITAL-ASSET PRICE CHANGES;
• FAILED OR DELAYED TRANSACTIONS;
• SLIPPAGE;
• NETWORK CONDITIONS;
• SMART-CONTRACT VULNERABILITIES;
• LIQUIDITY CONDITIONS;
• THIRD-PARTY SERVICES;
• CYBERSECURITY INCIDENTS;
• UNAUTHORIZED ACCOUNT ACCESS;
• LOSS OF DIGITAL ASSETS; OR
• LOSS OF ANTICIPATED PROFITS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENFLUX’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL BE LIMITED TO THE GREATER OF:

(a) THE FEES ACTUALLY PAID BY YOU TO SENFLUX FOR THE SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

(b) THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW.

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Senflux and its officers, directors, employees, affiliates, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from:

• your violation of these Terms;
• your unlawful use of the Services;
• your violation of another person’s rights;
• your unauthorized representations concerning Senflux;
• your fraudulent, negligent, or abusive conduct; or
• your violation of applicable law.

Senflux may modify, improve, expand, restrict, suspend, or discontinue any portion of the Services.

Changes may include:

• new intelligence capabilities;
• new markets or assets;
• revised deployment systems;
• new Platform features;
• revised product structures;
• changes to fees;
• changes to eligibility requirements;
• security improvements; and
• compliance-related changes.

Where appropriate, material changes will be communicated through the Platform or other reasonable means.

Senflux may update these Terms from time to time.

Updated Terms will become effective when posted to the website or otherwise communicated, unless a different effective date is stated.

Where required by applicable law, Senflux will provide additional notice or obtain additional consent.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

If you do not agree to revised Terms, you must discontinue use of the Services.

These Terms and any dispute arising from or relating to the Services will be governed by the laws of the Republic of the Marshall Islands, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

The parties acknowledge that mandatory laws applicable to a user or transaction may affect the enforceability or application of particular provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will, to the extent permitted by applicable law, be resolved through confidential and binding arbitration in accordance with the applicable laws and arbitration procedures of the Republic of the Marshall Islands.

Nothing in this Section prevents Senflux from seeking urgent or injunctive relief from a court of competent jurisdiction where necessary to protect its rights, property, systems, confidential information, or intellectual property.

Nothing in this Section limits rights that cannot lawfully be waived.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

The remaining provisions will remain in full force and effect.

Failure by Senflux to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision in the future.

You may not assign or transfer your rights or obligations under these Terms without Senflux’s prior written consent.

Senflux may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, corporate reorganization, or other business transaction.

These Terms, together with the Senflux Privacy Policy and any additional terms expressly incorporated into the Services, constitute the entire agreement between you and Senflux concerning your use of the Services.

Where a separate written agreement expressly applies to a particular Service, that agreement will govern to the extent of any conflict.
